1. Nature of the Service (Software Only)
Smart-HODL provides strictly non-discretionary software tools based on predefined mathematical logic. By using this service, you acknowledge that:
- The Provider is not a financial advisor, broker, fund manager, custodian, or execution venue.
- The Provider does not control, access, or hold user funds.
- All trading instructions are transmitted directly from the user’s environment to the connected exchange via user-owned API keys.
- The Provider does not route, intermediate, aggregate, or execute orders on behalf of the user.
- The software operates deterministically based on predefined rules and does not provide personalized investment advice or adaptive portfolio management.
2. Market Volatility & Capital Risk
Digital asset prices are extremely volatile and may experience rapid and unpredictable movements. Although Smart-HODL employs predefined rule-based logic for trade execution, it cannot prevent losses caused by adverse market conditions.
Events such as flash crashes, prolonged bear markets, exchange illiquidity, or structural market changes may result in significant drawdowns or total loss of allocated capital.
3. Technical, Infrastructure & Third-Party Risk
Trading automation depends on multiple technical and third-party components. The Provider is not responsible for losses caused by:
- Internet outages, VPS failures, or server misconfiguration.
- Exchange API downtime, latency, execution delays, or outages.
- Stablecoin de-pegging or blockchain network failures.
- Exchange insolvency, withdrawal freezes, or regulatory shutdowns.
- Improper API permissions, including enabling withdrawals.
4. Backtesting & Hypothetical Performance Limitations
Any historical performance, backtests, or simulations are hypothetical in nature and do not represent actual trading results.
5. No Profit Guarantee or Investment Protection
The Provider does not guarantee profits or positive returns. Any references to refunds relate solely to software license fees and do not represent a promise of trading performance.
6. Regulatory & Jurisdiction Disclaimer
Cryptofundia s.r.o. is not licensed or supervised by the Czech National Bank (ČNB) or any other financial authority. The service is offered solely as a technical software solution (SaaS).
The service is provided as a technical software tool and does not constitute a regulated financial service.
This Risk Disclosure forms an integral part of the Terms of Service.
